Travel Past 50 LLC Tours Terms and Conditions
LIABILITY AND RESPONSIBILITY
Please carefully read and understand the following information. By reserving a spot on this trip, or accepting tickets or documents, you consent and agree, personally and on behalf of your dependents, heirs, and administrators, to the following terms and conditions.
Travel Past 50 LLC, and its employees, agents, representatives, shareholders, affiliates, officers, directors, successors, and assigns (collectively referred to as “TP50”) do not own or operate any entity which provides goods or services for your trip including, for example, lodging facilities, airline, vessel, or other transportation companies, guides or guide services, local ground operators, providers or organizers of optional excursions, food service or entertainment providers, etc. All such persons and entities are independent contractors. As a result, TP50 is not liable for any negligent or willful act or failure to act of any such person or entity or of any other third party.
TP50 is not responsible whatsoever, in whole or part, and you, personally and on behalf of your dependents, heirs, and administrators release and hold TP50 harmless from liability, for any occurrences, including but not limited to any delay, loss, accident, personal injury, illness or death, medical expenses, or property damage occasioned by fault or negligence of any person, employee, or company entrusted with the performance of such services, from whatever cause, to you or your dependents, arising out of or related to this agreement and/or TP50’s services. Because an activity is included in your program fee does not imply that it’s obligatory to participate, and so you are participating in each activity voluntarily and at your own risk.
As a participant, you understand that all travel contains some risks that may be caused by forces of nature, or negligence, or actions of others. You agree on behalf of your dependents, heirs, and administrators to release and hold TP50 harmless from any and all liabilities, expenses, or inconveniences caused by late arrivals, departures, or any changes of schedule beyond our control, or the loss of or damage to your camera, other electronic equipment, accessories, luggage, money, jewelry, valuables, or other belongings whatsoever. Your airline ticket constitutes a contract between you and your airline. When told by TP50 administrators to do so, you are solely responsible for obtaining, scheduling, and arranging your own flights.
For any reason beyond our control, such as, but not limited to, Force Majeure or governmental actions, TP50 shall have the right to cancel the program and refund all monies to the participant. Such refund shall be the sole measure of any damages for and in any claim against TP50, its officers, employees, or agents by you, your dependents, heirs, or administrators. We reserve the right to make changes to the program with or without notice that might be necessary based on changing schedules.
TP50 reserves the right to accept, decline or remove, at any time, without refund, any person from the program who TP50 deems to be incapable of meeting the rigors and requirements of participating in the activities or for behavior that is deemed to be disruptive to the group or program. Any claim or dispute by you, your dependents, heirs, or administrators against TP50 arising out of or relating to this agreement and/or TP50’s services shall be settled by binding arbitration in accordance with the rules then in effect and adapted by the American Arbitration Association, which arbitration shall take place in the County of Winnebago, State of Illinois. A request for arbitration must be filed within one month from the participant’s scheduled departure.
PROGRAM
For full details please refer to our program itinerary. Only meals, accommodations, activities and ground transportation as indicated in the itinerary, are included. Unless otherwise noted, flights to/from our tour destination(s) are not included in the program and must be arranged by participant. Unless otherwise indicated, cost does not include passport fees, travel insurance or items of a personal nature such as beverages/snacks, Internet access fees, laundry fees, beverages, additional tips, etc.
Trip requires a minimum of ten (10) participants and is limited to those 21 years of age or older. We reserve the right to increase or decrease the number of participants by 2 on any Travel Past 50 tour.
USE OF IMAGE RELEASE
Travel Past 50 LLC reserves the right, and participant gives us permission, to use photographs, audio and/or video or other content of him or her taken during the trip for promotional and publicity purposes.
FLIGHT ARRANGEMENTS
When directed by TP50 administrators, you will be responsible for obtaining, scheduling, and arranging your own flights according to our directions.
IMPORTANT: PLEASE DON'T MAKE ANY NON-REFUNDABLE TRAVEL ARRANGEMENTS UNTIL GIVEN CONFIRMATION BY TRAVEL PAST 50 TO DO SO.
PAYMENT
Full payment is due upon registration. Your trip is confirmed only after having paid in full and having received confirmation from Travel Past 50 administrators that your payment has been processed.
We work on a first come, first served basis, and only those participants providing a scanned passport signature/picture page (must not expire within 6 months of return date), and completed documentation, along with full payment, will be accepted to the program.
CANCELLATION POLICY
All payments are non-refundable, unless TP50 cancels the program, in which case all monies will be promptly returned. Ten (10) participants minimum are required for this program.
If accepted to the program, you will be required to complete the registration form and pay in full at that time.
We require you to purchase travel insurance to insure against any unforseen circumstances that may cause you to cancel your registration. Your travel insurance should also insure you for any illness or injury you may sustain while on the tour, and should have a Covid endorsement that will cover any quarantines or other problems.
